Acceptance of Terms

By accessing or using Say the Word on Beat ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

Say the Word on Beat is a rhythm-based word game that allows users to play pre-made challenges and create custom challenges using their own images or AI-generated images. The Service offers both free and paid subscription tiers.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.

  • Free Plan: You may use the Service for personal, non-commercial purposes only.
  • Pro Plan: You may use the Service and content created through it for both personal and commercial purposes (e.g., monetized social media, marketing, business events, paid content creation).
  • One Account Per Person: Each account is for a single individual. You may not share, sell, or transfer your account to others.
  • No Sublicensing: You may not sublicense, resell, or redistribute access to the Service.

Account Registration

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating an account.
  • You are responsible for all activities that occur under your account.

Subscription and Payments

  • Free Plan: Allows you to create 1 custom challenge with limited features.
  • Pro Plan: A paid subscription ($2.99/month) that provides unlimited custom challenges and additional features.
  • AI Image Allowance: Free accounts receive a total of 5 AI-generated images. Pro accounts receive 100 AI-generated images per monthly allowance period. Unused generations do not roll over, and limits may be adjusted to protect service availability.
  • Billing: Pro subscriptions are billed monthly. Payments are processed by PayPal.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • Cancellation: You may cancel your subscription at any time from your account page. You will retain access to Pro features until the end of your current billing period.
  • Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.
  • Payment Processing: Payments are processed by PayPal. By subscribing, you also agree to PayPal's terms of service.

Refund Policy

We want you to be satisfied with our Service. Our refund policy is as follows:

  • 14-Day Refund Period: If you are not satisfied with your Pro subscription, you may request a full refund within 14 days of your initial purchase.
  • How to Request: Contact us at [email protected] with your account email and reason for the refund request.
  • Processing: Approved refunds will be processed through PayPal within 5-10 business days.
  • Exclusions: Refunds are not available after the 14-day period, for renewal payments, or in cases of Terms of Service violations.

Restrictions on Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that is offensive, harmful, or infringes on others' rights
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use the Service to develop a competing product
  • Share, sell, or transfer your account to any other person
  • Use automated tools, bots, or scripts to access the Service
  • Circumvent usage limitations (e.g., creating multiple free accounts to bypass limits)

Custom Challenges

When creating custom challenges, you agree to the following:

  • Content Ownership: You must own or have the right to use all images you upload. Do not upload content that is illegal, harmful, obscene, hateful, or infringes on others' rights.
  • Free Plan Challenges: You can create 1 custom challenge. You may delete it to create a new one.
  • Pro Plan Challenges: Challenges are stored permanently until you delete them from your dashboard.
  • Access: Challenge links are unlisted but not password-protected. Anyone with the link can view and play your challenge. You control who you share links with.
  • Removal: We reserve the right to remove any custom challenge at any time, for any reason, including but not limited to violations of these Terms.

AI-Generated Images

When using our AI image generation feature, you agree to the following:

  • Prohibited Content: You must not use AI image generation to create content that is illegal, harmful, obscene, pornographic, hateful, violent, or infringes on others' rights. Attempts to bypass content filters are strictly prohibited.
  • Prompt Logging: We may log and review your prompts for content moderation and to enforce our policies. Violations will result in account suspension or termination.
  • Content Moderation: All prompts and generated images are automatically screened. Content that violates our policies will be rejected.
  • Usage Limits: AI image generation requires an account and is subject to account, network, device, and abuse-prevention limits. Attempts to obtain additional free usage through multiple accounts, automated requests, altered device identifiers, proxies, or other circumvention methods are prohibited.
  • Enforcement: If we reasonably detect malicious, automated, excessive, fraudulent, or limit-evading image-generation activity, we may throttle or block requests, remove generated content, suspend AI features, restrict the associated account, network, or device, terminate accounts, and take other proportionate action necessary to protect the Service and its users.
  • Technical Signals: To enforce these limits, we may process privacy-preserving hashed network and device signals as described in our Privacy Policy. We do not store raw IP addresses in the AI quota counter.
  • No Guarantee: AI image generation is provided "as is." We do not guarantee the quality, accuracy, or appropriateness of generated images.

Your Content

When you create custom challenges, you retain ownership of your images and content. By uploading content, you grant us a limited license to display and process it as necessary to provide the Service. You are solely responsible for ensuring you have the right to use any content you upload.

Intellectual Property

The Service, including its design, features, and content (excluding user-uploaded content), is owned by Say the Word on Beat and protected by intellectual property laws. You may not use our branding, logos, or assets without prior written permission.

Data Security and Confidentiality

We implement industry-standard security measures, including HTTPS encryption, to protect your data. We will not sell your personal data to third parties or use your uploaded content for purposes other than providing the Service.

Service Availability and Support

  • Availability: We use commercially reasonable efforts to keep the Service available, but do not guarantee uninterrupted or error-free access.
  • Support: Support is available via email at [email protected]. Pro subscribers receive priority support.
  • Disclaimer: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Liability

To the maximum extent permitted by law, Say the Word on Beat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

Copyright and Illegal Content Reports

We respect intellectual property rights. If you believe content on the Service infringes your copyright or is illegal, please contact us at [email protected] with a description of the content and your contact information. We will promptly review and take appropriate action.

Termination

You may terminate this agreement at any time by cancelling your subscription and deleting your account, or by contacting us at [email protected]. We may suspend or terminate your access if you violate these Terms. Upon termination, your custom challenges and associated data will be deleted.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
